1. Acceptance of Terms
By accessing, registering, or using the Prana Health AI platform ("Platform")—a product of Prana Health Intelligence Pvt. Ltd. ("Company", "We", "Us") headquartered in Pune, India—you agree to be bound by these Terms of Service ("Terms"). These Terms constitute an electronic record within the meaning of the Information Technology Act, 2000 and require no physical or digital signatures.
2. Medical Disclaimer (Critical)
Prana Health AI is an artificial intelligence-driven analytical tool and is NOT a substitute for professional medical advice, diagnosis, or treatment.
- The Platform provides insights based on uploaded records and AI models. These insights must always be reviewed by a certified medical practitioner before taking any medical action.
- In the event of a medical emergency, do not rely on the Platform. Contact local emergency services immediately.
- Prana Health Intelligence Pvt. Ltd. holds no liability for adverse health outcomes resulting from actions taken or omitted based on the Platform's AI-generated insights.
3. User Obligations & Conduct
As a user of the Platform, you legally agree to:
- Provide accurate, current, and complete information during registration and profile creation.
- Maintain the security of your account credentials and not share access with unauthorized individuals.
- Only upload medical records, prescriptions, and SPDI that belong to you, or for individuals (like family members) for whom you have explicit legal authority or consent to do so.
- Not use the Platform for any illegal, harmful, or fraudulent activities.
4. Intellectual Property
All proprietary algorithms, source code, UI/UX designs, trademarks, and branding assets associated with the Platform are the exclusive intellectual property of Prana Health Intelligence Pvt. Ltd. and EyE PunE. Unauthorized reverse engineering, scraping, or distribution of Platform assets will result in immediate legal action under the Copyright Act, 1957 and Trade Marks Act, 1999.
5. Limitation of Liability
To the maximum extent permitted by Indian Law, Prana Health Intelligence Pvt. Ltd., its directors, employees, and engineering partners (EyE PunE) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Platform; (b) any unauthorized access to our secure servers.
6. Governing Law & Jurisdiction
These Terms shall be governed by and constructed in accordance with the laws of the Republic of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Pune, Maharashtra, India.
